It shall be unlawful for any person to sell cereal malt beverages at special events within the City of Potwin, Kansas without first obtaining a special event retailer’s temporary permit from the city clerk.

There is hereby levied a permit fee in the amount of $150.00 per day for each retailer issued a special event retailer’s temporary permit for the sale of cereal malt beverages, which fee shall be paid at the time the application is submitted to the city clerk. The application shall be submitted at least ten (10) days before the special event. Written application for the permit shall be made to the city clerk and shall clearly state:
(a) The name of the retailer.
(b) The location of the unpermitted premise to be issued the special event retailer’s temporary permit.
(c) Any anticipated need for sheriff, fire or other municipal services

The city clerk shall notify the Butler County Sheriff whenever a special event retailer’s temporary permit for the sale of cereal malt beverages has been issued and forward a copy of the permit and application to the Butler County Sheriff.

The special event retailer’s temporary permit shall allow the permit holder to offer for sale, sell and serve, cereal malt beverage for consumption on the premises, which may be open to the public, subject to the following:
(a) The special event retailer’s permit shall specify the premises for which the permit is issued;
(b) The special event retailer’s permit shall be issued for the duration of the special event, the dates and hours shall be specified in the permit;
(c) No more than four special event retailer’s permit may be issued to any one applicant in a calendar year; and
(d) The special event retailer’s permit shall not be transferable or assignable.
