A CHARTER ORDINANCE EXEMPTING THE CITY OF POTWIN, KANSAS. FROM THE PROVISIONS OF ARTICLE 2, CHAPTER 15 OF KANSAS STATUTES ANNOTATED REGARDING THE ELIGIBILITY, APPOINTMENT, TERMS. VACANCIES AND REMOVAL OF CITY OFFICERS AND EMPLOYEES.

WHEREAS, the Council has found that the City may. pursuant to state constitutional authority, utilize its home rule powers, to exempt itself from certain statutory provisions that do not apply uniformly to all cities;. and that none of the current provisions of Article 2. Chapter 15 of Kansas Statutes Annotated. and more specifically K.S.A. 15-204 and 15-209, apply uniformly to all cities: and that sufficient reasons exist to justify such exemption:

NOW, THEREFORE. BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF POTWIN, KANSAS. that:

SECTION 1. The City or Potwin, Kansas hereby elects to exempt and does exempt itself from all of the current provisions of Article 2, Chapter 15 of Kansas Statutes Annotated, and more specifically K.S.A. 15-204 and 15-209.

Section 2. The City of Potwin, Kansas shall hire, compensate, and retain all of its officers and employees pursuant to City guidelines, and amendments thereto, the City’s Employee Policies and Guidelines Manual.
